Terms & Conditions

Terms & Conditions

These Terms & Conditions apply to purchases made through the ARTKULT website at Artkult.gallery.

ARTKULT is operated by ARTKULT LTD, a private company limited by shares incorporated in England and Wales under company number 17490762, with registered office at 167-169 Great Portland Street, London, W1W 5PF, England (“ARTKULT”, “we”, “us”, “our”).

By placing an order through our website, you agree to these Terms.

1. About ARTKULT

ARTKULT is a curated online art platform selling original artworks and limited-edition works from selected artists.

Unless expressly stated otherwise, ARTKULT sells artworks in its own name and is the seller under the contract with the buyer. Artists may retain physical possession of artworks and arrange shipment on ARTKULT’s behalf in accordance with our requirements.

2. Artworks

We aim to present each artwork as accurately as reasonably possible, including information relating to the artist, medium, dimensions, edition, condition and other relevant characteristics.

Due to differences in screens, photography and lighting, colours and appearance may vary slightly from the physical artwork. Such variations do not affect your statutory rights where an artwork is materially different from its description.

Original artworks may contain natural variations, textures or characteristics resulting from the artist’s materials and creative process.

Where applicable, an artwork may be accompanied by a certificate of authenticity.

3. Availability and Orders

Many artworks available through ARTKULT are unique works and may also be exhibited or offered elsewhere.

Submitting an order does not by itself mean that we have accepted it. We may first confirm the artwork’s availability with the artist.

A contract between you and ARTKULT is formed when we send you confirmation that your order has been accepted.

If an artwork becomes unavailable after you place an order, we will notify you and refund any amount already paid.

We reserve the right to decline an order where reasonably necessary, including where an artwork is unavailable, payment cannot be authorised, there is an obvious pricing error, or we are required to do so for legal or regulatory reasons.

4. Prices and Payment

The price of each artwork will be displayed on the relevant artwork page.

Prices will state whether VAT is included or applicable. Delivery, insurance, customs duties and other charges will be displayed or communicated separately where applicable before the purchase is completed.

Payment must be made using one of the payment methods available at checkout.

ARTKULT receives payment from the buyer and separately accounts to the artist under its agreement with that artist.

5. Delivery

Delivery arrangements vary depending on the artwork’s size, value, location and handling requirements.

Some artworks may require specialist fine-art packing, crating, insurance or white-glove delivery. Where a delivery cost cannot reasonably be calculated automatically, we may provide a separate delivery quotation before the order is finalised.

We will provide an estimated delivery timeframe. Unless a different delivery period is expressly agreed with you, goods will be delivered within the period required by applicable law.

You are responsible for providing accurate delivery information and for ensuring that somebody is available to accept delivery where required.

6. Risk and Ownership

For consumer purchases, ARTKULT remains responsible for the artwork while it is in transit until it comes into your physical possession, except where applicable law provides otherwise.

Legal ownership of the physical artwork will pass to you once we have received payment in full and the artwork has been delivered to you.

Purchasing an artwork does not transfer copyright or other intellectual property rights in the artwork unless expressly agreed in writing.

7. Your Right to Cancel

If you are a consumer purchasing online, you may have a statutory right to cancel your purchase without giving a reason. Consumers in the UK and EU will generally have 14 days from the day they receive the artwork to exercise this right, subject to applicable legal exceptions. Consumers in other jurisdictions may have additional or different cancellation rights under applicable local law.

To exercise your cancellation right, you must notify us clearly at [EMAIL] before the cancellation period expires.

Certain goods may be excluded from the statutory cancellation right, including goods made to your specifications or clearly personalised, where the relevant legal requirements are met.

This does not affect your rights where an artwork is faulty, damaged, not as described or otherwise does not conform to the contract.

8. Returns Following Cancellation

If you cancel an eligible purchase, you must return the artwork within 14 days of notifying us of the cancellation.

Because artworks may be fragile, valuable or unsuitable for ordinary postal services, you must contact us before arranging a return so that appropriate packing and transport requirements can be confirmed.

Unless the artwork is faulty, damaged, incorrectly supplied or otherwise non-conforming, you will normally be responsible for the direct cost of returning it, provided that this has been disclosed to you as required by law.

Where an artwork cannot normally be returned by post, we will provide or make available the relevant return cost or an appropriate estimate where legally required.

You must take reasonable care of the artwork. We may make a deduction from any refund for loss in value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and condition of the artwork, to the extent permitted by law.

9. Refunds

Where you validly exercise your statutory cancellation right, we will refund the price paid for the artwork and any standard delivery charge that we are legally required to refund.

We are not required to refund any additional amount paid because you chose a more expensive delivery method than our standard delivery option, where applicable.

We may withhold the refund until we have received the artwork back or you provide evidence that it has been returned, whichever occurs first, where permitted by law.

Refunds will normally be made using the original payment method.

10. Damaged, Faulty or Misdescribed Artworks

Please inspect the artwork as soon as reasonably possible following delivery.

If an artwork arrives damaged, please contact us promptly at info@artkult.gallery and provide photographs of:

  • the artwork;
  • the packaging;
  • any visible damage; and
  • the shipping label where relevant.

Nothing in these Terms excludes or limits your statutory rights.

If an artwork is faulty, damaged, not as described or otherwise fails to meet applicable consumer-law requirements, please contact us and we will arrange the appropriate remedy in accordance with your legal rights.

11. Shipping and Insurance

ARTKULT may arrange delivery directly or coordinate delivery through the artist, courier or specialist fine-art logistics provider.

The fact that an artist or third-party carrier physically dispatches an artwork does not by itself change your contractual relationship with ARTKULT where ARTKULT is identified as the seller.

Insurance arrangements may vary according to the artwork and delivery method. Relevant delivery and insurance information will be communicated before purchase where applicable.

12. International Orders

ARTKULT may accept orders from customers outside the United Kingdom.

International purchases may be subject to import duties, taxes, customs formalities or other charges in the destination country. Where these are not included in the purchase price, we will make this clear before purchase where required.

International customers may also have mandatory consumer rights under the laws of their country of residence. Nothing in these Terms is intended to remove rights that cannot lawfully be excluded.

13. Identity and Compliance Checks

For certain transactions, ARTKULT may be required by law to carry out identity, anti-money laundering, sanctions or other compliance checks.

You agree to provide reasonable information or documentation requested for these purposes.

We may suspend, decline or cancel a transaction where reasonably necessary to comply with applicable legal or regulatory obligations. Where a transaction cannot proceed, any refund will be dealt with in accordance with applicable law.

14. Intellectual Property

All intellectual property rights in the ARTKULT website, branding, text, editorial content, design and other platform materials belong to ARTKULT or its licensors.

Copyright and other intellectual property rights in individual artworks generally remain with the relevant artist or rights holder.

Purchasing an artwork gives you ownership of the physical artwork only. It does not grant you the right to reproduce, commercially exploit, create merchandise from, distribute or otherwise use the artwork in a manner requiring permission from the copyright owner.

15. Our Liability

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to goods.

Subject to applicable consumer law, ARTKULT will not be responsible for losses that were not reasonably foreseeable when the contract was entered into or for losses arising from use of an artwork for business or commercial purposes where you purchased as a consumer.

Nothing in these Terms affects rights or remedies that cannot legally be excluded or restricted.

16. Website Information

We may update or amend information on the website from time to time.

While we take reasonable care to ensure that information is accurate, obvious errors may occasionally occur, including pricing, availability or descriptive errors. Where an obvious error affects an order, we will contact you before proceeding.

17. Privacy

We process personal information in accordance with our Privacy Notice and use cookies and similar technologies as described in our Cookie Policy.

18. Complaints

If you have a question or complaint regarding an order, please contact us at:

Email: info@artkult.gallery

Address: 167-169 Great Portland Street, London, W1W 5PF, England

We will aim to resolve complaints fairly and within a reasonable period.

19. Changes to These Terms

We may update these Terms from time to time.

The Terms applicable to your purchase will be those in force when your order is accepted, unless a change is required by law or regulatory authority.

20. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, this does not deprive you of any mandatory protections available to you under the laws applicable in your country of residence.

Any dispute will be subject to the jurisdiction of the courts determined by applicable law.
